Bhagtani Savannah Vrushali Patil case: What did we learn?

Mumbai, 22 August, 2018: Bhagtani Savannah victims have gotten used to being kept in the dark, and making their legal decisions based on very little information. In this respect, Vrushali Patil's case was like a bright ray of light in a dimly-lit room. Whatever else the merits or demerits of this legal initiative, one major benefit was the enormous amount of information that it yielded -- not only for Savannah but for Bhagtani victims of all Bhagtani projects. Paradoxically, people seem to have little willingness to analyze and digest this information! It appears that Bhagtani victims have grown tired of exercising their brains. "When are we getting our money or our flats? We are exhausted! We don't want to use our brains any longer!" is what they seem to be saying. Great escape for Bhagtani builders, lollipops for flat-buyers in Sapphire consent terms

Mumbai, 7th July, 2018: I wrote an article yesterday disclosing the consent terms signed by Sapphire Welfare Association (SWA) with Bhagtani bulders. *(In case you haven't read it, click here and read it first.) Until we got our hands on these consent terms two days ago and placed it in the public domain, it was a closely guarded secret.  If consent terms is a straightforward deal, why didn't SWA announce their achievement immediately? Why were there only cryptic references such as "It is time to buy the mithai, but don't distribute it". Why keep it secret? The reason is: the consent terms are a great escape for Bhagtanis. They seek to give a clean chit and easy exit from the Sapphire cases to the absconding builders. Bhagtani Sapphire Consent Terms signed: good or bad omen for victims?

Mumbai, 6th July, 2018: When the Sapphire Welfare Association (SWA) enrolled members and filed its Civil Suit/Plaint in Bombay High Court in a rush-rush hush-hush manner, the victims of Bhagtani Sapphire were split into two groups: (1) those who believed that their intent was genuinely to help the victims and (2) those who believed that their intent was to help the Bhagtanis get their criminal cases quashed, by giving the victims a lollipop.  My personal belief (based on my one year's experience of how Bhagtani's stooges manipulate people's minds through Whatsapp groups) is that the intention was solely to help Bhagtanis to come out of their legal troubles. I believe that gullible victims were drawn into the association by showing them them false hopes and dreams. ShubhAtika: How Origin Realtors & Ravi Group extort money from Bhagtani victims

Mumbai, 27th June, 2018: Many FIRs have been filed at Economic Offenses Wing (EOW) against Bhagtani builders for scamming hundreds of people in half a dozen Bhagtani projects, but no FIR has been filed against them for scamming people through the projects of allied builders such as Ravi Group and Origin Realtors LLP. It is high time for such FIRs to be registered against Bhagtanis where the co-accused are Ravi Group builders Ketan Tokershi Shah and Jayesh Tokershi Shah, and also Gaurav Ketan Shah, Yash Jayesh Shah and Bhavya Jayesh Shah of Origin Realtors LLP -- a close-knit family similar to the Bhagtanis. Some Bhagtani victims duped into investing in Shubh Atika are preparing to approach EOW with complaints of cheating, conspiracy and -- most significant of all -- extortion i.e. IPC Section 383 . Mumbai, 10th May, 2018: Hundreds of cheated home-buyers of Bhagtani builders (also known as Jaycee Homes and JVPD Properties) are running from pillar to post, trying to recover lakhs and crores of rupees that they paid for booking flats. Circumstances have led most victims to believe that Diipesh, Mukesh and Lakshman Bhagtani have no money. People have become almost convinced that over Rs 450 crore collected towards Riyo, Sapphire, Serenity and Savannah projects has somehow magically vanished like water poured on desert sand. "EOW officers say that they have freezed all the accounts,  and all accounts have zero balance," say victims who are in regular touch with the police. But if this is true, then how did Bhagtani repay an SBI loan of Rs 12.40 crore in April 2018? MahaRERA's Order to Refund Serenity victims: Useless? Or worse than useless?

Mumbai, 13th April, 2018: The MahaRERA order of 5th April is a victory for victims of Bhagtani Serenity, because it grants the reliefs sought by the complainants. It directs JVPD Properties to refund the amounts paid by the complainants towards booking a flat in Serenity, along with interest @ 10.05% and also Rs 20,000/- towards costs. Well hurrah, we got what we asked for. Or did we? Let us think about how things will play out in future. Does anybody believe that complainant Pradeep Badkur (and others like him who will receive similar orders very shortly) will receive the money from Bhagtani? Not likely. Under the current circumstances, it is almost guaranteed that Bhagtani will respond to this order with typical non-compliance. What can the complainant do if Bhagtani does not refund the money? Bhagtani Serenity victims: What's the DEVELOMENT POTENTIAL of your project land?

Mumbai, 8th April, 2018: Yes, we are all talking about how the builder who buys Serenity project from Xander Finance (or Debt Recovery Tribunal) should complete the project and give flats to the allottees. But keep in mind that the consideration value of the project will depend on the development potential of the project land. Do we know what its development potential is? Let us first understand the contradictions in our case. According to Diipesh Bhagtani's second affidavit to Bombay High Court, Serenity project has 389 allottees.  However, Bhagtani's declaration to MahaRERA, visible on its website, says something very different. It says that Serenity project has only 86 flats and zero booked apartments i.e. zero allottees. Nobody would accuse Bhagtani of telling the truth, and so such self-contradictions were to be expected. Bhagtani Flat buyers: Questions raised by TRANSFER OF PROPERTY ACT & CONTRACT ACT in your Allotment Letter?

Mumbai, 8th April, 2018: This article is relevant to all home-buyers, although it is written for the 2500-odd victims of Bhagtani builders, i.e. the people who booked flats in Bhagtani Riyo (Mira Road), Sapphire (Dahisar), Serenity (Powai) and Savannah (Kanjurmarg). Bhagtani's victims have no registered agreement of sale; they only have allotment letters that looks like this specimen . Although they have paid well over 20% of flat's consideration value, the builders have deliberately avoided the duty cast upon them by MOFA (Maharashtra Ownership Flats Act) to execute registered sale agreements. Does RERA order to Xander safeguard Serenity Victims?

Mumbai, 28th March, 2018: It appears on the face of it, that MahaRERA order on Xander's interest in Bhagtani Serenity dated 16th March safeguards the interests of Serenity allottees. Mumbai Mirror interpreted the order in a positive way, and said, "Maharashtra Real Estate Regulatory Authority... ruled that Xander Finance... will have to protect the interests of the home buyers." Is this positive interpretation 100% correct, 50% correct, or only 10% correct? Before we start searching for answers to this question, let us acknowledge the efforts of Trivesh Pooniwala and other Serenity victims, and Adv Tanuj Lodha who ably represents them. But is it a contract, or just worthless pieces of paper? Let us take a close look at your transaction. Keep fighting, don't buy Bhagtani's "khayali pulao"

Mumbai, 16th March, 2018: Yes, legal battles are tough, time-consuming, exhausting and costly. You win some and you lose some; that is the nature of the beast. Riyo victims' MPID application at sessions court was rejected on technical grounds, making it necessary for the group to approach high court. Serenity victims' RERA application seeking to have Xander declared a co-promoter appears a bit shaky; whether it will be accepted or rejected by RERA judge Kapadnis will be seen in a few days. Yes, legal battles require patience and alertness. It took 3-4 months of hard work for Riyo victims who were complainants and intervenors to put Diipesh Bhagtani in prison; he almost succeeded in fooling the judiciary, getting anticipatory bail and flying to Dubai like his father and brother.
