Report says Lodha flat is really 12% smaller than agreement

3rd January, 2019, Mumbai: In November 2017, we published an article titled, " Measure your flat, Lodha Group has cheated you ". Anil Kapur (name changed), the owner of a 1BHK studio apartment at Lodha Belmondo project, near Pune, took our advice seriously. He hired a chartered engineer & valuer to measure his flat. The engineer-valuer's report finding is that the actual carpet area is over 12 percent less than the 490 square feet mentioned in the registered agreement. The actual carpet area is 430 sq ft i.e. 60 sq. ft. less. Even if we count "exclusive terrace" and "exclusive balcony" area, the Belmondo flat is 30 sq. ft. less! How Lodha Group exploits flat-buyers with crooked Terms & Conditions -- Case Study #1

Mumbai, 27 April, 2018: Here is a live example of how Lodha Group traps unwary flat-purchasers by imposing unfair terms and conditions. Kavita Shinde booked flat no. A401 in Casa Treetop in Lodha Upper Thane, located on Mumbai-Nashik Highway, and has been receiving extortionate demand letters to pay late-fees for a delay in payment, although she had not delayed any payment.  Kavita booked her flat on 11th May, 2017 by paying Rs 90,000/-, and followed this up by paying Rs 3.17 lakhs on 5th June, 2017. As per the application form, the next "milestone" was executing the registered agreement. The third installment could become payable only after the registration. Example of  Lodha Group's payment schedule, mentioned in the Application Form. Quite often, these schedules mention strict deadlines such as 45 days between consecutive payments. Mumbai, 4th October 2017: The order passed by Justice A N Badar for yesterday's proceedings of the Bhagtani Riyo case has deep significance, not only for hundreds of flat buyers, but also for flat-buyers and builders in general.  Download Bombay High Court's order . Mumbai, 4th October, 2017: Give a big cheer if you booked a flat in Bhagtani Riyo! Yesterday's Bombay High Court order in Criminal Anticipatory Bail Application no. 1553 of 2017, gave relief to ALL victims of the Bhagtani Riyo Mira Road Project (and not just complainants and interveners). Hundreds of victims of both Riyo 1 and Riyo 2 are happy with the order of Justice A M Badar, who heard the case yesterday. Uploading of the order is keenly awaited! Riyo victims are to be repaid with interest within six months. Mumbai, 29th September, 2017: The hopes of hundreds of victims of Bhagtani builders ill-fated Riyo project in Mira Road today when Justice Revati Mohite Dere of Bombay High Court gave a strict order requiring Dipesh, Mukesh and Lakshman Bhagtani to pay back Rs 22 crore to the victims within 6 months, as a pre-condition for their anticipatory bail. Bhagtani Riyo Investors get second chance to become interveners in High Court

 22/09/2017, Mumbai: There’s good news and bad news for Bhagtani Riyo flat-purchasers. First the bad news: Our hearing in Bombay HC did not happen today as the judge -- Justice Revati Mohite Dere -- was absent today and is scheduled to resume only on Monday. So, our matter (anticipatory bail application no. 1533 of 2017 held yesterday evening for extension of pre-arrest bail granted to Dipesh, Mukesh and Lakshman Bhagtani) was rescheduled for hearing on 13 th October as per High Court causelist. Advocate Shraddha Dubepatil, who has filed her intervention application on behalf of 75 flat-buyers, will try to have it heard on Tuesday by mentioning the case before the judge on Monday morning. At the anticipatory bail application no. 1533 of 2017 held yesterday evening for extension of pre-arrest bail granted to Dipesh, Mukesh and Lakshman Bhagtani, Bombay High Court directed the advocates of intervenors to submit lists of holders of Allotment Letters and/or cancellation deeds (flat-buyers of Bhagtani Riyo) wishing to seek refund under the court’s protection.
