When flat-buyer gets MARRIED to builder... but not the other way around! ONE-SIDED RELATIONSHIP

Image
Flat buyers in India typically have a one-sided relationship with the builder. The flat purchaser is tied to the agreement or contract, whereas the builder is usually free. to break the agreement at any point of time. The flat-buyer stands to lose token amount, which is 10% of the consideration value. The builder stands to lose almost nothing if the contracts breaks, and he stands to gain the 10% of the consideration value by doing nothing. The flat-buyer is tied by the 10 percent token that he pays, but the builder is not tied. The entire relationship is at the builder's discretion, will and convenience. Why are flat-buyers entering such one-sided relationships? ISSUED IN PUBLIC INTEREST BY Krishnaraj Rao 9821588114 and 8169471229 krish.kkphoto@gmail.com Mumbai

Two ways to escape from builder's clutches and get refund of ALL your money

Image

Indian laws give builders a LICENCE TO TELL LIES & MISLEAD! Flat-buyers & redevelopments, beware!

Image
Ordinary law-abiding folks are not aware that it is NOT considered a criminal offense to tell lies on websites or in public. It is not a CRIME to falsely call yourself a doctor or lawyer or builder, and it is not a crime to falsely claim professional or financial credentials for work that you haven't done. This leads many unwary citizens into money-traps, where they lose a lot of money. Please be careful. How to escape from Lodha's "Sales Trap" without losing money

Image
18th June, 2019, Mumbai: Many flat-buyers of Lodha Group's various projects -- especially Palava City, New Cuffe Parade and World Towers -- want a refund. They want to cancel their deal, and get their money back with interest. The usual reasons are: (1) build quality issues (2) delayed possession (3) carpet area deficiency (4) unfair trade practices (5) unauthorized or improperly authorized construction (6) mis-selling and false promises. But getting money back from Lodha is difficult. The terms and conditions mentioned in the application form, allotment letter and agreement form make it clear that Lodha will retain 10% of the consideration amount, and make a lot of other deductions too. So, how to get back your refund without losing a lot of money? Well, friends, here is something you can try. There is a big loophole in Lodha's agreement format for various projects. It is a clause designed by Lodha's lawyers to trap customers, but this same clause can be used by ...

Lodha World Towers: 35 floors may be demolished @ World View & World Crest

Image
Mumbai, 11th June, 2019: Unnoticed by investors, Lodha's dream of building a 441-metre 117-storey tower called World One -- supposedly the "world's tallest residential tower" -- has been given a quiet burial. For a whole decade, builder-politician Mangal Prabhat Lodha, after strategic acquisition of the land-rich Shreeniwas Cotton Mills Ltd, moved heaven and earth to get height permission for constructing a 441 metre World One tower, protruding into the flight path of planes taking off and landing from Mumbai's Santacruz Airport.  Airport Authority of India (AAI) bluntly refused to play ball. For nine years, AAI has resisted Lodha's persistent lobbying efforts, and given him permission for only 285 metres. So, after constructing over 80 floors in 2015, Lodha had to demolish the top floors; currently , World One is only 76 storeys high .  Lodha World View, as seen from the 43rd floor of World One But Lodha is still encroaching on Mumbai's aviation ...

Warning! Lodha Flat Buyers may face Income Tax Nightmare

Image
Mumbai, 20th November 2017: Buying a flat from Lodha Group can land you in deep trouble with the Income Tax Department. The small print in Lodha Group's Application Form compels you to not deduct TDS on your installments as required by law. Lodha's sales staff and Application Form illegally compels you to delegate your legal responsibility to Lodha. Such delegation can land you in deep trouble. Not only will you invite penalties from the Income Tax authorities, but worse, it can lead to scrutiny of your tax returns. Nobody in his right mind wants to invite I-T scrutiny through careless actions, but that's what can happen to you if you blindly trust Lodha's paperwork!  As a flat purchaser, you have a statutory obligation under section 194-IA of the Finance Act to deduct tax and furnish details of your property transaction to the Income Tax department. There are no exemptions. Read this article to understand your obligation as a flat-purchaser. There is no pro...

How Lodha Group's "Application Form" Traps Unwary Customers

Mumbai, 16th November, 2017: Lodha Group's Application Form is like a bear-trap for prospective flat buyers. When you are preparing property papers and legal documents, every single word has to be clearly understood and agreed upon. But Lodha's customers are forced to make fatal blunders in the paperwork right in the beginning.
